The Pensions Division in the Commercial Department advises clients on the Retirement Benefits matters. Our clients include Pension Schemes and service providers for Schemes such as Administrators and Founders of Retirement Benefit schemes. One of the administrators that the Firm has been retained to act for has a docket of over 250 schemes. The Firm drafts Trusts Deeds and Rules for Pensions Schemes and other documents such as Deeds of Amendment and Deeds of Appointment.

During the last ten years, the Firm has and continues to timeously advise various clients on issues/matters arising out of the amendments proposed and made by the Cabinet Secretary of the National Treasury during the budget speech and its impact on their Schemes. The Firm has advised various Pension Schemes, Administrators and Liquidators of the Schemes on various aspects of the law under the Retirement Benefits Act. These include advise on conversion of schemes from Defined Benefits to Defined Contribution; how to treat any deficits; the Statutory Remedial Plans; Amended Trust Deeds , how to conduct meetings amongst other corporate governance matters.

The Firm is currently also on the Panel of Advocates for the regulatory body in the industry, the Retirement Benefits Authority and is also a Registered member of the Association of Retirement Benefits Schemes.

The firm assists clients in:- – Establishing unit trust structures, drafting trust deeds and related contracts. – Registration of unit trusts with the regulator and advises on reporting requirements.
