12.11.2021 – Legal Alert – Central Bank of Kenya (Amendment) Bill 2021
In August 2021, the Finance and National Planning Committee approved the Central Bank of Kenya (Amendment) Bill 2021, following public consultations. The amendment sought to regulate lending rates for digital lenders, and empower the Central Bank of Kenya (“CBK”) to license digital lenders. It also sought to regulate the types of digital loan products offered by digital lenders in Kenya.
06.08.2021- Client Alert- Anti-Counterfeit (Recordation) Regulations 2021
In 2019, the Statute Law (Miscellaneous Amendment) Act of 2018 introduced a recordation system under the Anti-Counterfeit Act, 2008. The Anti-Counterfeit Authority (the Authority) was given the mandate to register Trademarks relating to goods to be imported into Kenya, the place of registration notwithstanding. The move asserted Kenya’s efforts to combat counterfeiting and piracy especially at the ports of entry.
23.11.2020-Data Protection Act 2019 Alert
On November 8th, 2019, the President signed into Law the Data Protection Act, 2019 (“DPA”) and the same came into effect on November 25th, 2019. The Act gives effect to Article 31 (c) and (d) of the Constitution of Kenya, 2010 which guarantees the right to privacy to every citizen.
23.11.2020-Tax Alert – Finance Bill 2020
The Finance Bill, 2020 (the Bill) was published in the Kenya Gazette on 5th May, 2020, a few days after the enactment of the Tax Laws (Amendment) Act, 2020.
The Bill contains proposed amendments to tax and other laws. Most of the amendments had been included in the Tax Laws (Amendment) Bill, 2020 (the TLAB) but were later dropped during the legislative process.
23.11.2020-Tax Law (Amendment) Act 2020 II
The Tax Laws (Amendment) Act, 2020 (the Act) was assented into law on 25th April, 2020. Noteworthy, the Act was meant to incorporate the fiscal proposals that had been outlined by the President on 25th March, 2020 to cushion the economy against the adverse effects of Covid-19 (the Pandemic).

This report provides a profile of institutional investors in Kenya and an assessment of their attitude and appetite for investment in earlystage investment funds targeting small and medium sized enterprises (SMEs).1 The report was commissioned by GrowthFin, a programme of the Financial Sector Deepening (FSD) Trust that works with policy makers, donors, industry associations and financial institutions to identify and overcome impediments to the provision of financial services to SMEs.
